摘要: 环境污染强制责任保险(以下简称“环强险”)作为一种通过法律手段强制实施的保险制度，旨在通过保险机制来分散和转移环境污染风险，保护受害者的合法权益，并推动企业的环境责任履行。然而，尽管环强险在理论上具有诸多优势，但在实际操作中却面临着诸多法律困境。文章将从立法缺失、制度设计不合理、监管不力以及市场机制不完善等方面，深入探讨环强险面临的法律困境，并提出相应的应对策略。

Abstract: Environmental Pollution Compulsory Liability Insurance (hereinafter referred to as “Environmental Insurance”), as an insurance system enforced by legal, aims to disperse and transfer environmental pollution risks through insurance mechanisms, protect the legitimate rights and interests of victims, and promote the fulfillment of corporate environmental responsibilities. However, its many advantages in theory, Environmental Insurance faces many legal dilemmas in actual operation. This paper will delve into the legal dilemmas faced by Environmental Insurance from various aspects, such legislative gaps, unreasonable system design, inadequate supervision, and imperfect market me- chanisms, and propose corresponding coping strategies.
