《电子商务法》视角下电商平台责任与消费者保护

E-Commerce Platform Liability and Consumer Protection from the Perspective of the “E-Commerce Law”

摘要: 本文以《中华人民共和国电子商务法》实施为研究背景，系统分析其在规范平台责任与保护消费者权益方面的制度创新、实施成效与现实挑战。研究表明，该法通过信用评价体系规制、平台责任界定及消费者知情权保障等制度设计，有效缓解了虚假交易、捆绑搭售、押金退还难等痛点问题。然而，在责任认定标准模糊、惩罚力度不足及新型业态监管空白等方面仍面临挑战。本文建议通过细化“相应责任”认定标准、建立动态罚款机制及构建协同治理体系等措施，进一步完善电子商务法律治理框架，推动数字经济高质量发展。

Abstract: This paper takes the implementation of the “E-commerce Law of the People’s Republic of China” as the research background and systematically analyzes its institutional innovations, implementation effects and practical challenges in regulating platform liability and protecting consumers’ rights and interests. Studies show that through institutional designs such as the regulation of the credit evaluation system, the definition of platform liability, and the protection of consumers’ right to know, this law effectively alleviates pain points such as false transactions, bundled sales, and the difficulty in refunding deposits. However, there are still challenges in aspects such as ambiguous standards for responsibility determination, insufficient punishment intensity and regulatory gaps in new business forms. This article suggests further improving the legal governance framework for e-commerce and promoting the high-quality development of the digital economy by measures such as refining the criteria for determining “corresponding responsibilities”, establishing a dynamic fine mechanism, and building a collaborative governance system.
