A Brief Analysis of Criminal Legal Subject and Criminal Liability in the Era of Artificial Narrow Intelligence

摘要: 本文探讨了弱人工智能时代刑事责任主体和责任承担的问题。随着人工智能技术的快速发展而带来的刑事风险对传统刑事责任理论提出了新的挑战。本文首先界定了弱人工智能机器人和强人工智能机器人的划分，其次分析了在当前所处弱人工智能机器人时代下，弱人工智能作为刑事责任主体的可能性，及其设计者、生产者和使用者之间的责任承担。最后，提出了完善弱人工智能时代刑事责任体系的建议，包括立法完善、司法应对和技术保障等方面。本研究对于应对人工智能技术带来的刑事法律挑战具有重要的理论和实践意义。

Abstract: This article explores the issues of criminal legal subject and liability assumption in the era of artificial narrow intelligence. The criminal risks brought about by the rapid development of artificial intelligence technology pose new challenges to the traditional criminal responsibility theory. This paper first defines the division between Artificial Narrow Intelligence and Artificial Superintelligence. Secondly, it analyzes the possibility of Artificial Narrow Intelligence Robot being the subject of criminal responsibility in the current era, as well as the criminal liability among designers, producers and users. Finally, suggestions for improving the criminal responsibility system were put forward, including aspects such as legislative improvement, judicial response and technical guarantee. This research has significant theoretical and practical significance for addressing the criminal legal challenges brought about by artificial intelligence technology.
