普惠视角下学前教育法治的价值意蕴及实践进路

The Value Implications and Practical Approaches of the Rule of Law in Preschool Education from the Perspective of Inclusiveness

摘要: 《中华人民共和国学前教育法》的颁布标志着我国学前教育迈入法治化新阶段，但普惠化进程仍面临资源分配不均、质量差异显著等挑战，迫切需要发挥法治作用，以法治的强制力保障学前教育的充分普惠。法治通过公共价值保障全民受惠、通过正义价值促进公平分配、通过效率价值优化资源配置、通过秩序价值规范发展路径，为学前教育普惠化提供强大支撑。然而，现实中仍存在制度规范体系不完善、政府执法与监管效能不足、法治氛围薄弱等问题。需要通过构建普惠导向的财政投入与资源分配制度、健全执法机制与动态监管体系、改变法治宣传手段加以解决，推进学前教育法治化的进程。

Abstract: The promulgation of the “Preschool Education Law of the People’s Republic of China” marks that China’s preschool education has entered a new stage, but the process of inclusiveness still faces challenges such as uneven distribution of resources and significant quality differences. The rule of law provides strong support for the inclusiveness of preschool education by ensuring public welfare and inclusiveness through public values, promoting fair distribution through justice values, optimizing resource allocation through efficiency values, and standardizing development paths through order values. However, in reality, there are still problems such as imperfect institutional norms, insufficient government law enforcement and regulatory efficiency, and a weak rule of law atmosphere. It is necessary to build an inclusive oriented financial investment and resource allocation system, improve the law enforcement mechanism and dynamic supervision system, and change the means of rule of law publicity to promote the process of rule of law in preschool education.
