论破产重整企业的市场信用修复制度
On the Market Credit Repair System of Enterprises Undergoing Bankruptcy Reorganization
摘要: 企业若存在失信行为会受到各部门的联合惩戒,市场失信行为记录会导致企业在融资贷款、政府采购、市场准入等多方面会受到较大的限制,影响企业重整计划的推行。使重整企业恢复经营能力是良好营商环境的重要体现,因此在重整计划启动后,暂时消除失信记录、保证重整企业获得平等的市场机会是重整制度的应有之义。重整企业的市场信用修复需要加强有关法律制度、制定统一的上位法来协调重整制度和市场监管制度之间的价值平衡、引入第三方市场修复制度、加强对信用修复市场的监管,同时还需要联合各部门系统性消除市场信用修复中的障碍,加强监管保证市场的正常运行,打击违法犯罪行为,激活市场活力。
Abstract: If an enterprise has any act of bad faith, it will be subject to joint punishment by various departments. The record of bad faith in the market will lead to significant restrictions on the enterprise in many aspects such as financing and loans, government procurement, and market access, which will affect the implementation of the enterprise’s reorganization plan. Restoring the operational capacity of the reorganized enterprises is an important manifestation of a favorable business environment. Therefore, after the reorganization plan is initiated, temporarily eliminating the records of bad faith and ensuring that the reorganized enterprises obtain equal market opportunities are the inherent meanings of the reorganization system. The market credit repair of restructured enterprises requires strengthening the relevant legal system, formulating a unified higher-level law to coordinate the value balance between the restructuring system and the market supervision system, introducing a third-party market repair system, strengthening the supervision of the credit repair market. At the same time, it is also necessary to unite various departments to systematically eliminate the obstacles in market credit repair and strengthen supervision to ensure the normal operation of the market, crack down on illegal and criminal activities, and activate market vitality.
