电子商务平台的安全保障义务研究

Research on the Security Assurance Obligations of E-Commerce Platforms

摘要: 当前正处于网络经济飞速发展的时代，电子商务平台已经逐渐取代实体商铺成为公民日常生活消费的主要场所之一，目前我国现行法律规范为电商平台的经营者设置了安全保障义务。从危险控制理论与报偿原理、制度演进以及消费者权益保护的角度考虑，该义务的设置具有其正当性。但在现有法律体系中，电商平台经营者安全保障义务的使用规范仍存在诸多缺陷。对此应当依托《电子商务法》第38条第2款的条文规定，从消费者权益保护的角度重构电商平台经营者安全保障义务的解释论。

Abstract: At present, we are in an era of rapid development of the online economy. E-commerce platforms have gradually replaced physical stores and have become one of the main places for citizens’ daily consumption. Currently, the legal norms in China have set security guarantee obligations for the operators of e-commerce platforms. From the perspectives of risk control theory and compensation principle, institutional evolution, and consumer rights protection, the establishment of this obligation has its legitimacy. However, in the current legal system, there are still many deficiencies in the usage norms of the security guarantee obligations of e-commerce platform operators. In this regard, the interpretation of the security guarantee obligations of e-commerce platform operators should be reconstructed from the perspective of consumer rights protection based on the provisions of Article 38, Paragraph 2 of the “E-commerce Law”.
