摘要: 数字时代，平台等非公权力主体依托数据垄断与算法控制，获得了具有准公权性质的数字私权力。这种新型权力冲击了传统公权力与私权利的二分格局，其隐蔽性及扩张性对用户权益、市场竞争以及社会秩序构成了严峻的威胁。现有法律规范在规制平台责任分配与监管模式上存在显著不足。本文旨在维护数字正义与社会秩序，通过分析数字私权力的生成逻辑以及其规制的必要性，在现有法律体系的基础上，探索出适用性更强的规制路径。完善数字平台领域的立法，构建多元主体协同的穿透式监管机制，为数字社会的法治提供理论支撑。

Abstract: In the digital age, non-public power entities such as platforms have obtained digital private power with quasi-public power nature by relying on data monopolies and algorithmic control. The new type of power has challenged the dichotomy of traditional public power and private rights, its concealment and expansiveness pose a serious threat to users’ rights and interests, market competition and social order. The existing legal norms have significant deficiencies in regulating the responsibilities of regulatory platforms and regulatory models. This article aims to maintain digital justice and public order. By analyzing the generation logic of digital private power and the necessity of regulation, and based on the existing legal system, it explores a more applicable regulatory path. Improve legislation in the field of digital platforms, build a multi-subject collaborative and penetrating supervision mechanism, and provide theoretical for the rule of law in the digital society.
