涉案虚拟货币处置问题研究

摘要: 虚拟货币已成为犯罪活动的重要工具，虚拟货币的匿名性、去中心化与我国对虚拟货币交易的严格管控给虚拟货币的处置带来重重问题。欲对涉案虚拟货币妥善处置，首先应当明确虚拟货币虚拟财产的地位，并基于此指导处置流程。在实践中，虚拟货币处置出现传统冻结措施失灵、虚拟货币处置价值难以确定、变现过程存在风险等困境，严重制约相关案件处置流程的合法性。为解决此问题，有必要建立第三方机构辅助处置机制，完善处置规范流程并构建相关处置变现规则，以实现涉案虚拟货币处置的有序运行。

Abstract: Virtual currency has become an important tool for criminal activities, and the anonymity, decentralization, and strict control of virtual currency transactions in China have brought numerous problems to the disposal of virtual currency. To properly dispose of the involved virtual currency, the first step is to clarify the status of virtual currency and virtual property, and based on this, guide the disposal process. In practice, the disposal of virtual currencies has encountered difficulties such as the failure of traditional freezing measures, difficulty in determining the value of virtual currency disposal, and risks in the monetization process, which seriously restrict the legality of the relevant case disposal process. To solve this problem, it is necessary to establish a third-party institution assisted disposal mechanism, improve the disposal standard process, and construct relevant disposal monetization rules to achieve the orderly operation of the disposal of virtual currencies involved in the case.
