新型用工关系下劳动者的权益保护研究
Research on the Protection of Workers’ Rights and Interests under the New Employment Relationship
摘要: 随着互联网的发展,新型用工关系在共享经济的影响下呈现出新的表现形式,其虚拟化、就业灵活性和时间地点的可变性的特点给新型劳动关系的认定和保护带来了重大挑战。在实践中,新型用工关系下劳动者的合法权益时常受到侵犯,随着社会发展和矛盾的激化,如何对新型用工关系下的劳动者的权益进行保护,这是劳动法领域待以解决的一大难题。目前,新型用工模式发展时间短,相关法律的规制还不够完善,同时在实践中也缺乏经验,难以对其形成充分的保障。我国对这一类劳动者权益保护的研究相对薄弱,亟需理论指导。因此本文主要针对新型用工关系下所存在的劳动者身份判定、劳动关系以及劳动法现行制度调整的困境,并对其权益保护障碍背后的原因进行分析,从劳动立法、企业平台以及劳动关系从属性本身几个方面对该论题进行论证并提出具体的制度设计,以完善对这一类劳动者合法权益的保护路径。
Abstract: With the development of the Internet, new labor relations have taken on new forms under the influence of the sharing economy. The characteristics of virtualization, employment flexibility and time and place variability have brought great challenges to the identification and protection of new labor relations. In practice, the legitimate rights and interests of workers under the new employment relationship are often violated. With the intensification of social development and contradictions, how to protect the rights and interests of workers under the new employment relationship is a big problem to be solved in the field of labor law. At present, the development time of the new employment mode is short, the relevant laws and regulations are not perfect, and the lack of experience in practice, it is difficult to form an adequate guarantee for it. The research on this kind of laborer’s rights protection is relatively weak in our country, so it needs theoretical guidance. Therefore, this paper mainly aims at the dilemma of determining the identity of laborers, labor relations and adjusting the current system of labor law under the new employment relationship, and analyzes the reasons behind the obstacles of protection of their rights and interests. It demonstrates this topic from the aspects of labor legislation, enterprise platform and labor relations and puts forward specific system design. In order to improve the protection of the legitimate rights and interests of this kind of workers.
