Legal Reflections on Data Privacy Protection for Enterprises and Platforms in the E-Commerce Economy

摘要: 随着近年来电商经济的迅速发展，电商平台中用户的数据隐私保护成为不容忽视且亟待解决的难题。本文将聚焦电商经济下的数据隐私保护问题，剖析我国数据隐私保护法规的现状及电商企业与平台在数据隐私保护上的实践，揭示数据收集、存储、共享及跨境流动等环节面临的挑战，包括合规与安全风险、企业效率利益平衡难题、第三方合作隐患、法律冲突与用户权利实现障碍等。进而从多维度展开，提出完善法规监管、强化企业内部管理与技术防护、加强协同合作、完善救济措施等法律保护路径，旨在为电商行业的数据隐私保护提供理论支持与实践指导，助力电商经济实现健康可持续发展。

Abstract: With the rapid development of e-commerce economy in recent years, the protection of users’ data privacy in e-commerce platforms has become a challenge that cannot be ignored and needs to be solved urgently. This paper focuses on data privacy protection in the e-commerce economy, analyzes the current status of data privacy protection regulations in China and the practices of e-commerce enterprises and platforms in data privacy protection, and reveals the challenges of data collection, storage, sharing, and cross-border flow, including compliance and security risks, the problem of balancing the interests of enterprise efficiency, the potential danger of third-party cooperation, and the obstacles of conflict of laws and the realization of users’ rights. Then, from a multi-dimensional perspective, it puts forward the legal protection paths of improving regulations, strengthening internal management and technical protection of enterprises, strengthening cooperation and improving relief measures, aiming to provide theoretical support and practical guidance for data privacy protection in the e-commerce industry, and to help e-commerce economy realize healthy and sustainable development.
