网络购物合同中格式条款的法律规制问题研究

摘要: 随着电子商务的快速发展,网络购物合同中的格式条款因其便利性以及高效率性在网络购物合同中得到了大量的应用。但是,因为格式条款不具有协商性以及消费者与经营者地位的不对等,格式条款在实践过程中经常被滥用,导致消费者的权益被损害。本文以“网络购物合同中格式条款的法律规制问题研究”为题,通过分析我国现行法律体系及监管现状,发现当前商家在制定条款过程中存在利益失衡现象,赋予自己更多的单方面解释权,以及现行法律存在规定模糊、消费者认知程度整体偏低、平台滥用优势、执法标准不统一等问题。在此基础上提出完善立法体系、提升消费者教育水平、优化司法救济以及强化行政监管等方面的对策建议,进而助力推动构建更加公平、透明的电子商务法治环境,切实保障消费者合法权益。
Abstract: With the rapid development of e-commerce, standard terms in online shopping contracts have been widely applied due to their convenience and high efficiency. However, because standard terms lack negotiability and there is an imbalance in the status between consumers and operators, they are often abused in practice, resulting in the infringement of consumers’ rights and interests. This paper, titled “Research on the Legal Regulation Issues of Standard Terms in Online Shopping Contracts”, analyzes the current legal system and regulatory situation in China and finds that there is an imbalance of interests in the process of formulating terms by merchants, who are granted more unilateral interpretation rights. There are also problems such as ambiguous provisions in current laws, low overall awareness among consumers, abuse of advantages by platforms, and inconsistent enforcement standards. Based on this, it proposes countermeasures and suggestions such as improving the legislative system, enhancing consumer education, optimizing judicial relief, and strengthening administrative supervision, in order to help promote the construction of a fairer and more transparent e-commerce legal environment and effectively protect the legitimate rights and interests of consumers.
