论行政协议司法审查标准的构建

On the Construction of Judicial Review Standards for Administrative Agreements

摘要: 合法性审查标准是行政诉讼的核心原则。但是行政协议的特殊属性决定了其审查标准的特殊性。自《行政诉讼法》修改及相关司法解释的出台，关于行政协议的审查标准一直存在争议。在处理行政协议相关纠纷时，需充分考量其“行政”与“契约”的双重本质，妥善平衡合法性与合约性的关系，并在我国法律体系的框架内，构建科学、合理的行政协议司法审查标准。

Abstract: The standard of legality review is the core principle of administrative litigation. However, the special nature of administrative agreement determines the particularity of its review standard. Since the revision of the Administrative Procedure Law and the introduction of relevant judicial interpretations, there has been controversy about the review standards of administrative agreements. When dealing with disputes related to administrative agreements, we should fully consider the dual nature of “administration” and “contract”, properly balance the relationship between legality and contract, and build a scientific and reasonable judicial review standard for administrative agreements within the framework of China’s legal system.
