网络虚拟财产的刑法保护研究

摘要: 随着互联网和网络数据产业的飞速发展，网络虚拟财产的概念日益成熟，财产犯罪行为也逐步向线上转移，互联网用户对自身虚拟财产安全的关注度不断提升。国家虽大力推动网络虚拟财产的立法保护，但由于虚拟财产定位模糊，在价值判定和犯罪认定上存在诸多问题。网络虚拟财产存储于各大服务平台的服务器数据中，能让用户在平台设定的网络区域内进行消费和交易，与网络用户的虚拟行为密切相关。随着信息技术的飞速发展，虚拟财产不仅包括网络支付行为伴随的网络货币、虚拟物品，还涵盖游戏账号、虚拟货币等信息类产品。这些虚拟财产理应受法律保障，刑法有必要将其列入保障范围，以提高虚拟财产纠纷处理的效率和方向性。只有明确虚拟财产的价值，才能更好地对侵犯网络虚拟财产的犯罪行为进行处罚。

Abstract: With the rapid development of the Internet and network data industry, the concept of network virtual property is becoming increasingly mature, and property crimes are gradually shifting online. Internet users are paying more and more attention to the security of their virtual property. Although the country is vigorously promoting the legislative protection of network virtual property, due to the vague positioning of virtual property, there are many problems in value determination and crime identification. Network virtual property is stored in the server data of major service platforms, allowing users to consume and trade in the network area set by the platform, which is closely related to the virtual behavior of network users. With the rapid development of information technology, virtual property not only includes online currency and virtual items accompanying online payment behaviors, but also covers information products such as game accounts and virtual currency. These virtual properties should be protected by law, and it is necessary for the criminal law to include them in the scope of protection to improve the efficiency and directionality of handling virtual property disputes. Only by clarifying the value of virtual property can we better punish criminal acts that infringe on online virtual property.
