Research on Legal Issues of Privacy Protection and Data Security in Electronic Transactions

摘要: 本文旨在深入剖析电子交易商业领域的隐私保护与数据安全法律问题，以应对当前电子交易行业快速发展背景下日益凸显的相关法律挑战，通过综合运用文献研究法，全面梳理国内外相关法律规范及学者的学术成果，同时结合案例分析法，深入探索典型电子交易隐私与数据安全事件，从而精确识别现有的法律体系在个人信息过度收集、数据泄露责任界定以及跨境数据传输等方面存在的空白，基于此，提出完善立法、加强执法监督、提高行业自控力以及强化用户维权意识等多维度的解决方案。研究发现，只有通过法律、监督、行业以及消费者自身的共同努力，才能构建起更为完善的电子交易隐私保护与数据安全法律保障体系，进而促进电子交易行业的健康可持续发展。

Abstract: This paper aims to conduct an in-depth analysis of privacy protection and data security legal issues in the electronic commerce field, addressing the increasingly prominent legal challenges arising from the rapid development of the electronic commerce industry. By comprehensively reviewing relevant domestic and international legal regulations and academic achievements through literature research, and combining case analysis to deeply explore typical electronic transaction privacy and data security incidents, this paper accurately identifies gaps in the existing legal system regarding excessive personal information collection, data breach liability determination, and cross-border data transmission. Based on these findings, multi-dimensional solutions are proposed, including improving legislation, strengthening law enforcement supervision, enhancing industry self-regulation, and reinforcing user awareness of rights protection. The research concludes that only through joint efforts from legal systems, regulatory supervision, industry self-discipline, and consumer empowerment can a more comprehensive legal protection system for electronic transaction privacy and data security be established, thereby promoting the healthy and sustainable development of the electronic commerce industry.
