On the Legal Responsibilities of E-Commerce Platform Operators

摘要: 随着数字经济的深度发展，电子商务已成为社会经济活动的核心组成部分，而电子商务平台作为连接商家与消费者的枢纽，其角色的复杂性与影响力日益凸显。本文立足电子商务平台的“新型交易中介”法律定位，以《电子商务法》第三十八条等核心条款为基础，系统剖析现行法律框架下平台法律责任存在“必要措施”界定模糊、“相应责任”内涵不明、审核机制形式化、安全保障义务缺失等问题，提出构建“必要措施”具体场景的制度解释、厘清“相应责任”内涵与裁量标准、完善审核机制、搭建安全保障义务体系，明确电子商务平台法律责任与边界，增强电子商务行业活力。

Abstract: With the deepening development of the digital economy, e-commerce has become a core component of socio-economic activities. As a hub connecting merchants and consumers, the complexity and influence of e-commerce platforms have become increasingly prominent. This paper is grounded in the legal classification of e-commerce platforms as “new types of transaction intermediaries”, and based on core provisions such as Article 38 of the E-Commerce Law, it systematically analyzes the issues existing in the current legal framework regarding the legal responsibilities of platforms, including the vague definition of “necessary measures”, the unclear connotation of “corresponding responsibilities”, the formalization of review mechanisms, and the absence of security obligations. It proposes to establish a system of interpretive rules for the specific scenarios of “necessary measures”, clarifying the scope and discretion standards of “corresponding responsibilities”, improving review mechanisms, and establishing a security obligation framework. These measures aim to clarify the legal responsibilities and boundaries of e-commerce platforms, thereby enhancing the vitality of the e-commerce industry.
