算法价格歧视下电商消费者知情权保护研究
Research on the Protection of E-Commerce Consumers’ Right to Know under Algorithmic Price Discrimination
摘要: 目前,人们越来越习惯于网上消费,并且随着算法技术的高速发展,消费平台会根据消费者习惯给出更为精准的推送。但是与之相伴的是算法价格歧视现象的发生,不同消费者在对同一产品进行消费时会由于个人消费习惯不同,平台会收取不同的价格,并且消费者对此毫不知情。消费者知情权在算法价格歧视下严重被侵害,所以可以从完善电子商务信息披露的规定、健全消费者个人信息数据使用相关法律规定、加强对消费者知情权遭受侵害后的权利救济等方面来保护消费者权益,促进数字经济的健康发展。
Abstract: At present, people are increasingly accustomed to online consumption, and with the rapid development of algorithm technology, consumer platforms can provide more accurate recommendations based on consumers’ habits. However, accompanied by this is the occurrence of algorithmic price discrimination. When different consumers purchase the same product, the platform will charge different prices due to their different personal consumption habits, and consumers are completely unaware of this. Consumers’ right to know is seriously infringed under algorithmic price discrimination. Therefore, we can protect consumers’ rights and interests and promote the healthy development of the digital economy by improving the regulations on e-commerce information disclosure, perfecting the legal provisions related to the use of consumers’ personal information and data, and strengthening the right relief for consumers when their right to know is infringed.
