数字人民币跨境网络支付中的法律问题分析

Analysis of Legal Issues in E-CNY Cross-Border Online Payments

摘要: 数字人民币跨境支付的实现可提升人民币在国际支付中的整体份额，从而进一步维护我国的电商网络支付的安全。但从目前来看，数字人民币跨境能够支付仍存在较多法律问题尚未解决。本文首先分析了数字人民币在跨境电商平台网络支付中存在的主要法律问题，然后提出了包括构建分层监管与隐私保护的法律框架、主导国际标准协同与差异化合作、建立风险防控与区域示范体系等解决数字人民币跨境网络支付中的法律问题的有效路径，旨在为促进电商跨境网络支付发展提供一定支持与帮助。

Abstract: The realization of cross-border payments with E-CNY can increase the overall share of RMB in international payments, thereby further safeguarding the security of China’s e-commerce online payments. However, at present, there are still many unresolved legal issues in cross-border payments with E-CNY. This paper first analyzes the major legal issues existing in E-CNY online payments on cross-border e-commerce platforms, and then proposes effective paths to address the legal issues in E-CNY cross-border online payments, including constructing a legal framework for hierarchical supervision and privacy protection, leading the coordination of international standards and differentiated cooperation, and establishing systems for risk prevention and control as well as regional demonstration. It aims to provide certain support and assistance for promoting the development of cross-border online payments in e-commerce.
