数字时代自媒体作品著作权的保护困境和完善路径

摘要: 在数字技术迅猛发展的背景下，自媒体平台迅速崛起并广泛渗透到社会生活的各个层面，成为大众文化生产的重要载体。自媒体作品因其多元性、独创性、共享性和广泛性等特征，极大地激发了公众的创作热情，推动了文化表达的个体化与大众化。然而，自媒体创作门槛的降低也带来了著作权保护方面的诸多问题如权属认定难、侵权行为隐蔽性强、维权成本高、平台责任模糊等问题。鉴于此，必须将健全法律规范、强化平台责任、提升技术手段、增强公众版权意识等手段作为完善路径，以期为数字时代背景下构建完善的著作权保护机制提供理论支持与现实指引，为推动社会主义文化强国建设提供法治保障。

Abstract: With the rapid development of digital technology, self-media platforms have emerged and increasingly penetrated all aspects of social life, becoming important carriers of mass cultural production. Due to their characteristics of diversity, originality, shareability, and wide reach, self-media works have greatly stimulated public enthusiasm for creation and promoted the individualization and popularization of cultural expression. However, the lowered threshold for self-media creation has also brought about a series of problems in copyright protection, such as difficulties in rights attribution, hidden and diverse forms of infringement, high costs of rights protection, and ambiguous platform responsibilities. In view of this, it is necessary to improve the copyright protection system through legal refinement, strengthened platform responsibilities, enhanced technical tools, and increased public awareness of copyright. These measures aim to provide both theoretical support and practical guidance for building a sound copyright protection mechanism in the digital era, and to offer legal guarantees for advancing the construction of a socialist cultural power.
