电子商务平台中NFT交易侵权责任及保护路径研究

Research on Infringement Liability and Safeguarding Mechanisms for NFT Transactions in E-Commerce Platforms

摘要: 随着非同质化代币(NFT)在艺术、音乐、游戏等领域的兴起，其交易市场日益繁荣，但在交易中的侵权问题也随之浮现。作为NFT数字作品交易的中间人，NFT交易平台在NFT数字作品交易中往往起着重要的作用。因此，本文在分析NFT数字作品的概念、交易法律属性及国内外交易规则差异的基础上，从NFT交易平台的类型划分及责任认定出发，探讨平台在NFT交易中的法律地位与责任边界，从而针对NFT交易平台责任认定的法律困境，提出合理确定交易平台的侵权责任范围、加强对NFT交易平台的监管等保护路径，以期为NFT产业的可持续发展提供法律保障。

Abstract: With the rise of non-fungible tokens (NFT) in art, music, gaming, and other fields, their trading markets have experienced significant growth, yet infringement issues during transactions have also emerged. As critical stakeholders in NFT digital artwork transactions, NFT trading platforms play a pivotal role in these processes. This study analyzes the conceptual definition of NFT-digitalized works, their legal attributes in transactions, and divergences in domestic and international regulatory frameworks. By categorizing NFT platforms into distinct operational models and examining their liability thresholds, the paper explores the legal status and liability boundaries of platforms in NFT transactions. To address the legal ambiguities in platform accountability, the research proposes targeted solutions, including rationally defining the scope of infringement liability for trading platforms and strengthening regulatory oversight. These recommendations aim to provide legal safeguards for the sustainable development of the NFT industry.
