浅论“大数据杀熟”下的消费者权益保护
A Brief Discussion on the Protection of Consumers’ Rights and Interests under “Big Data Price Discrimination”
摘要: 随着大数据技术的快速发展,“大数据杀熟”现象日益普遍,成为侵害消费者权益的新型手段。本文从“大数据杀熟”的概念、特征及其对消费者权益的侵害等入手,分析现有法律框架在应对“大数据杀熟”问题上的不足,并探讨消费者权益保护的路径。研究表明,“大数据杀熟”行为严重侵害了消费者的知情权、个人信息权、公平交易权和选择权等合法权益。为有效遏制“大数据杀熟”行为,需要从完善法律法规、加强监管执法、提升消费者意识和能力等方面构建全方位的保护体系。通过多管齐下,有效维护消费者合法权益,促进数字经济健康发展。
Abstract: With the rapid advancement of big data technology, the phenomenon of “big data-enabled discriminatory pricing against regular customers” has become increasingly prevalent. It has emerged as a novel form of infringement on consumers’ rights and interests. This paper commences by delving into the concept, characteristics of “big data-enabled discriminatory pricing against regular customers”, and its implications for consumer rights violations. It then analyzes the limitations of the existing legal framework in tackling this issue. Furthermore, the paper explores viable approaches to safeguarding consumers’ rights and interests. Findings indicate that the practice of “big data-enabled discriminatory pricing against regular customers” seriously encroaches upon consumers’ legitimate rights, including the right to be informed, the right to personal information, the right to fair trade, and the right to choose. To effectively contain such practices, it is essential to establish a comprehensive protection mechanism. This can be achieved through measures such as improving relevant laws and regulations, strengthening regulatory enforcement, and enhancing consumers’ awareness and capabilities. By implementing these multi-pronged strategies, we can effectively safeguard consumers’ legitimate rights and interests and foster the healthy development of the digital economy.
