网络购物中格式条款的法律规制研究

Research on the Legal Regulation of Standard Terms in Online Shopping

摘要: 网络购物中的格式条款在提升效率的同时，其固有的不公平性与网络环境的隐蔽性叠加，导致“霸王条款”泛滥，严重侵害消费者公平交易权与知情权。本文旨在研究其法律规制现状与完善路径。研究指出，当前规制体系存在立法原则性强、司法审查标准不一、行政监管滞后等困境。为此，本文提出应从明确“显著提示”的认定标准、完善内容公平性的审查规则、加强行政监管等多维度进行体系化完善，以期实现对消费者权益的有效保障，促进数字经济健康发展。

Abstract: While standard terms in online shopping improve efficiency, the superposition of their inherent unfairness and the concealment of the online environment has led to the proliferation of “unfair standard clauses”, seriously infringing on consumers’ rights to fair trade and right to know. This paper aims to study the current situation and improvement paths of their legal regulation. The research points out that the current regulatory system faces dilemmas such as overly principled legislation, inconsistent judicial review standards, and lagging administrative supervision. To this end, this paper proposes to systematically improve the system from multiple dimensions, including clarifying the identification standards for “prominent prompt”, improving the review rules for content fairness, and strengthening administrative supervision, so as to effectively protect consumers’ rights and interests and promote the healthy development of the digital economy.
