算法推荐下电商平台侵权视频的治理困境与平台责任——以“必要措施”的司法展开为中心

Governance Dilemmas and Platform Liability for Infringing Videos on E-Commerce Platforms under Algorithmic Recommendation—A Judicial Analysis Centred on “Necessary Measures”

摘要: 算法推荐在电商平台的运用，虽显著提升了视频化内容的分发效率和用户黏性，但也带来了利用侵权视频进行引流、营销等一系列著作权侵权问题。本文通过对电商平台算法推荐各阶段进行法律评价，以及对现有“避风港规则”和“红旗规则”中“知道或应当知道”再解释和“必要措施”的展开进行讨论，实现版权保护、电子商务技术创新和经营者销售自由三方利益平衡。

Abstract: Although the deployment of algorithmic recommendation on e-commerce platforms has markedly increased the distribution efficiency of video content and user engagement, it has also spawned a series of copyright infringements in which unauthorized videos are leveraged for traffic generation and marketing. By legally evaluating each stage of algorithmic recommendation on these platforms and by re-interpreting the “actual or constructive knowledge” standard and elaborating on the “necessary measures” under the existing safe-harbor and red-flag rules, this paper seeks to balance the interests of copyright protection, technological innovation in e-commerce, and merchants’ freedom to sell.
