论无障碍视听数字平台合理使用作品研究

Research on the Reasonable Use of Works by Barrier-Free Audiovisual Digital Platforms

摘要: 我国《著作权法》第二十四条第十二款适当扩展了“无障碍视听作品”的合理使用范围，而后批准加入的《马拉喀什条约》更是强调应当保障阅读障碍者学习知识和获取信息的基本人权。为在网络环境中对该阅读障碍者合理使用条款进行恰当解释与正确适用，本文将从两起案情相似但判决不一的“无障碍影视APP”侵权纠纷案出发，探究现行立法下合理使用条款对无障碍视听数字平台的适用困境，并结合司法适用趋势与域外立法发展，探寻对该条款进行深入解释的完善空间，明确专门为阅读障碍者提供无障碍格式版网络作品的被授权实体的权利与义务，以此平衡数字空间中无障碍视听平台与原视听作品著作权人之间的合法权益。

Abstract: Article 24 (12) of China's Copyright Law appropriately expands the scope of rational use of “barrier-free audiovisual works”, and the subsequently ratified Marrakesh Treaty further emphasizes the need to protect the basic human rights of people with reading disabilities to acquire knowledge and information. To properly interpret and correctly apply the reasonable use clause for people with reading disabilities in the network environment, this article will start with two contradictory judgments, explore the application dilemma of reasonable use clauses to barrier-free audiovisual digital platforms under current legislation, and combine judicial application trends with overseas legislative developments to explore the space for further interpretation of this clause. The purpose is to clarify the rights and obligations of authorized entities that specifically provide barrier-free online works for people with reading disabilities, thus balancing the legitimate rights and interests of people with reading disabilities and copyright owners in the digital space.
