农村宅基地使用权流转法律问题研究

Research on the Legal Issues of the Transfer of Rural Homestead Use Rights

摘要: 农村宅基地问题不仅关系到农民的切身利益，而且还关系到农村的社会稳定和经济的发展。宅基地使用权在性质上属于用益物权，但对于农村宅基地使用权的流转却受到了法律和政策的限制，为了更好地保障农民权益以及对土地资源的合理利用，本文着眼于宅基地使用权流转的现状及其困境，并就解决该困境提出了完善宅基地使用权流转的相关措施，以此保障宅基地使用权能够自由流转，推进城乡一体化建设。

Abstract: The issue of rural homesteads not only concerns the immediate interests of farmers, but also the social stability and economic development of rural areas. The right to use rural homesteads is a usufructuary right in nature. However, the transfer of the right to use rural homesteads is restricted by laws and policies. To better protect farmers’ rights and interests and rationally utilize land resources, this paper focuses on the current situation and predicament of the transfer of the right to use rural homesteads and proposes relevant measures to improve the transfer of the right to use rural homesteads, so as to ensure the free transfer of the right to use rural homesteads and promote the integrated development of urban and rural areas.
