新业态下共享用工模式中的劳动者权益保护问题研究
Research on the Protection of Workers’ Rights and Interests in the Shared Employment Model under the New Business Model
摘要: 新业态下共享用工作为劳动力资源优化配置的一种新型用工关系,具有显著的优越性,得到了国家政策的鼓励和支持。同样地,信息化的发展、企业存在淡季和旺季的周期性、国家政策以及不可抗力等突发事件的人力资源需求,为共享用工能在未来长期发展奠定了基石。本文深入探讨了新业态背景下共享用工模式中劳动者权益保护的现状、存在的问题及完善对策。通过分析共享用工模式的特点及运行机制,梳理了当前劳动者权益保护在劳动关系认定、工资报酬、社会保险、职业安全与健康等方面面临的困境,并从完善法律法规、加强政府监管、推动企业责任落实等角度提出了相应的解决建议,以期为促进共享用工模式的健康发展、保障劳动者合法权益提供理论支持和实践参考。
Abstract: Shared work under the new business model is a new type of employment relationship that optimizes the allocation of labor resources and has significant advantages, which has been encouraged and supported by national policies. Similarly, the development of information technology, the cyclical nature of low and peak seasons in enterprises, national policies, and the demand for human resources in the face of unexpected events such as force majeure have laid the foundation for the long-term development of shared employment in the future. This article explores in depth the current situation, existing problems, and improvement strategies of protecting workers’ rights and interests in the shared employment model under the background of new business formats. By analyzing the characteristics and operational mechanisms of the shared employment model, this paper summarizes the current difficulties faced by the protection of workers’ rights and interests in areas such as labor relationship recognition, wage compensation, social insurance, occupational safety and health. Corresponding solutions are proposed from the perspectives of improving laws and regulations, strengthening government supervision, and promoting the implementation of corporate responsibilities, in order to provide theoretical support and practical reference for promoting the healthy development of the shared employment model and safeguarding the legitimate rights and interests of workers.
