数字时代背景下离线权的法理分析与实现路径
A Legal Analysis and Implementation Path of the Right to Offline in the Context of the Digital Age
摘要: 数字时代,劳动者存在隐形加班认定难的困境,现有研究主要通过休息权、隐私权等其他权利予以保障,然而,上述权利却无法实质性解决劳动者能否离线以及离线的程度问题,因此,在厘清劳动者离线权概念、特点以及产生与发展,指出我国引入离线权的现实必要性并对其进行正当性证成,通过将离线权引入劳动法的方式予以破解,实现劳动者离线权权益保护的法定化、劳动者人格尊严权的实质性保障,以期实现对劳动者离线权益的保护与救济的规范化。
Abstract: In the digital age, workers face the challenge of recognizing invisible overtime, and existing research mainly provides protection through other rights such as the right to rest and privacy. However, these rights fail to substantively address the issue of whether workers can be offline and to what extent they can be offline. Therefore, this article clarifies the concept, characteristics, emergence, and development of the worker’s right to offline, highlights the practical necessity of introducing the right to offline in China, and justifies its legitimacy. By incorporating the right to offline into labor law, the article aims to achieve the legalization of workers’ offline rights protection and substantively safeguard their dignity, with the goal of standardizing the protection and remedy of workers’ offline rights.
