基层环保垂改后存在的问题与完善建议
Problems and Suggestions for Improvement after the Reform of Environmental Protection at the Grass-Roots Level
摘要: 环保垂改是我国生态环境保护的重大改革措施,主要涉及环境监察权、环境监测权以及环境执法权的再配置,对地市环保部门的人事管理、职责划分、程序重构等方面产生了重大影响。虽然环保垂改对我国环保执法的地方保护问题发挥了积极作用,但地市环保执法依然面临多方面的突出问题如法制层面的不完善、基层环保部门与政府的关系未厘清、缺乏完备的环保执法监督体系等,本文提出进一步完善相关法律法规、明确界定环保部门与地方政府的关系、完善执法监督体系。通过这些综合措施,我们能够更好地应对环境挑战,维护生态平衡,以确保未来的可持续发展。
Abstract: Environmental protection reform is a major reform measure for ecological and environmental protection in China. It mainly involves the reconfiguration of environmental supervision rights, environmental monitoring rights and environmental law enforcement rights, which has had a significant impact on personnel management, division of responsibilities and procedure restructuring of local and municipal environmental protection departments. Although the environmental protection reform has played a positive role in the local protection of China’s environmental protection law enforcement, the local and municipal environmental protection law enforcement still faces many outstanding problems, such as imperfection at the legal level, the lack of the relationship between grass-roots environmental protection departments and the government, and the lack of a complete environmental protection law enforcement supervision system. This article proposes to further improve the relevant laws and regulations, clearly define the relationship between environmental protection departments and local governments, and improve the law enforcement supervision system. Through these comprehensive measures, we can better respond to environmental challenges and maintain ecological balance to ensure sustainable development in the future.
