论我国“吹哨人”制度的构建
On the Establishment of “Whistleblower” System in China
摘要: “吹哨人”制度，是指组织内部人员将组织所实施的危害或可能危害社会公共利益的违法或不当行为向有关部门或社会公众披露的制度。本文从“吹哨人”制度的含义出发，挖掘“吹哨人”制度对于公民、社会和国家的意义，在充分考察国内外研究现状的基础上，结合我国目前相关制度现状，研究其存在的理论困境，并有针对性地探索建立一套适合我国国情的、具有中国特色的“吹哨人”制度。
Abstract: “Whistleblower” system refers to the system whereby the internal personnel of an organization disclose to the relevant departments or the public the illegal or improper behaviors that endanger or may endanger the social and public interests. This paper starts from the meaning of “whistleblower” system, excavates the significance of “whistleblower” system for citizens, society and the country, studies the theoretical dilemma on the basis of fully investigating the research status at home and abroad and combining the current situation of relevant systems in China, and explores the establishment of a set of “whistleblower” system with Chinese characteristics that is suitable for China’s national conditions.
