摘要: 随着我国人口老龄化程度不断加深，退休超龄人员再就业已成为劳动力市场的重要组成部分。本文深入探讨退休超龄人员再就业过程中涉及的法律关系认定、社会保险缴纳、劳动争议处理等核心法律问题，结合最新司法解释和政策规定，分析现行法律框架下的权益保障困境，并提出服务项目法律风险防范体系的构建路径，为推动超龄劳动者权益保障和法律制度完善提供理论参考。

Abstract: With the deepening of the aging of China’s population, the re-employment of retired over-age people has become an important part of the labor market. This article deeply explores the core legal issues such as legal relationship identification, social insurance payment, and labor dispute handling involved in the re-employment process of retired and overage personnel. In combination with the latest judicial interpretation and policy provisions, it analyzes the dilemma of protecting rights and interests under the current legal framework, puts forward the construction path of the legal risk prevention system of service projects, and provides theoretical reference to promote the protection of the rights and interests of overage workers and the improvement of the legal system.
