Research on Civil Liability for the Abuse of Personalized Recommendation Algorithms by E-Commerce Platforms

摘要: 本文深入讨论了算法的滥用引发新型侵权问题背景下消费者权益、市场竞争秩序及社会公共利益所面临的严峻挑战，通过分析现行法律框架对算法滥用行为的规制，揭示了电商平台滥用个性化算法推荐的民事责任面临主体认定模糊、因果关系证明困难、过错原则适用滞后等困境。本研究旨在深入剖析电商平台滥用推荐算法的具体场景与损害后果，厘清其在不同法律关系中(如合同、侵权、消费者保护)的民事法律责任，推动平台算法向更公平、透明、负责任的方向发展。

Abstract: This article delves into the severe challenges posed to consumer rights, market competition order, and public interests amid emerging infringement issues stemming from algorithmic abuse. By analyzing the regulatory framework for algorithmic misconduct under current laws, it reveals that civil liability for e-commerce platforms abusing personalized algorithmic recommendations faces dilemmas including ambiguous liability attribution, difficulties in proving causation, and lagging application of fault principles. This study aims to dissect specific scenarios and harmful consequences of e-commerce platforms’ recommendation algorithm abuses, clarify their civil liabilities across different legal relationships (such as contracts, torts, and consumer protection), and promote the evolution of platform algorithms toward greater fairness, transparency, and accountability.
