电子商务领域消费者个人信息保护
Consumer Personal Information Protection in E-Commerce Field
摘要: 在信息技术推动电子商务快速发展的背景下,消费者个人信息在交易中被大量收集、存储与分析,其保护问题愈发凸显。本文首先界定了电子商务消费者个人信息的内涵、外延及独特性,指出其具有与网络交易紧密相关、动态性强、关联性高等特点;接着梳理我国现行法律法规在该领域的保护规定,剖析出法律边界模糊、司法救济不完善、处罚力度不足等问题。随后,深入分析电子商务消费者个人信息保护面临的三大困境,即信息收集方式隐蔽、算法侵害、监督管理机制缺陷并从几个维度提出针对性的保护对策,旨在为维护消费者权益、促进电子商务健康发展提供理论支持与实践参考。
Abstract: Under the background that information technology promotes the rapid development of e-commerce, consumers’ personal information is collected, stored and analyzed in transactions, and the protection problem becomes more and more prominent. Firstly, this paper defines the connotation, extension and uniqueness of e-commerce consumer personal information, and points out that it is closely related to online transactions, dynamic and highly relevant. Then it examines the protection provisions of current laws and regulations in this field, and analyzes the problems such as vague legal boundaries, imperfect judicial relief and insufficient punishment. Then, it deeply analyzes the three dilemmas faced by e-commerce consumers’ personal information protection, namely, hidden information collection methods, algorithm infringement and defects in supervision and management mechanisms, and puts forward targeted protection countermeasures from several dimensions, aiming at providing theoretical support and practical reference for safeguarding consumers’ rights and interests and promoting the healthy development of e-commerce.
