论跨境电商商标侵权风险的研究
Research on the Risks of Trademark Infringement in Cross-Border E-Commerce
摘要: 随着跨境电子商务的持续扩张,中国企业的国际化步伐显著加快。然而,各国商标制度之间的差异与电子商务无国界经营特点之间存在结构性矛盾,频繁引发商标抢注、权利冲突及侵权争议。本文基于企业不同发展阶段与商业模式,从商标注册策略、合规使用与监测机制、纠纷应对与体系完善三个层面进行系统分析,构建涵盖事前预防、事中控制与事后应对的全流程治理框架。研究指出,小微企业、中型企业与大型企业应分别遵循差异化路径,平台型与自营型企业则需构建符合自身运营特点的商标合规体系,以实现对商标相关风险的有效管控。通过系统化的注册布局、持续性监测以及多元化维权手段的综合运用,跨境电商企业不仅能够有效降低法律风险,亦有助于提升品牌在国际市场的稳定性,进而推动中国品牌的全球化。
Abstract: With the continuous expansion of cross-border e-commerce, Chinese enterprises have accelerated their internationalization significantly. However, the structural contradiction between differences in national trademark systems and the borderless nature of e-commerce often leads to trademark squatting, rights conflicts and infringement disputes. Based on enterprises’ development stages and business models, this paper systematically analyzes three aspects—trademark registration strategies, compliant use and monitoring mechanisms, and dispute response and system improvement—and builds a full-process governance framework covering pre-event prevention, in-event control and post-event response. It points out that small/micro, medium-sized and large enterprises should take differentiated approaches; platform-based and self-operated enterprises need to establish trademark compliance systems matching their operations to effectively control trademark-related risks. Through systematic registration planning, continuous monitoring and diversified rights protection, cross-border e-commerce enterprises can not only reduce legal risks, but also enhance brand stability in the international market, thus promoting the in-depth globalization of Chinese brands.
