数字平台自我优待行为的反垄断法规制

Anti-Trust Law of Self-Preferential Behaviors of Digital Platforms

摘要: 在数字经济时代，数字平台“自我优待”行为因可能破坏市场竞争秩序、损害消费者及中小企业权益，影响社会福利，成为反垄断法关注的焦点。本文结合《反垄断法》及配套规章，立足我国平台经济发展现状，从法理基础、现实困境与制度构建三方面展开研究。首先，通过剖析数字平台自我优待的反竞争本质及其类型化特征，明确其法律属性；其次分析当前我国规制数字平台自我优待的现实困境；最后，借鉴国际经验提出符合中国实际的规制路径，为数字经济领域的反垄断立法与执法提供理论支撑，助力构建规范有序的数字市场法治环境，服务社会主义法治国家建设目标。

Abstract: In the digital era, the “self-preferencing” practices of digital platforms have become a focal point in antitrust law due to their potential to disrupt market competition, harm the interests of consumers and small-to-medium enterprises, and negatively impact social welfare. Grounded in the development reality of China’s platform economy and drawing on the Anti-Trust Law and its supporting regulations, this paper conducts a tripartite analysis—examining the jurisprudential basis, practical challenges, and institutional construction. First, it elucidates the legal nature of self-preferencing by dissecting its anti-competitive essence and typological characteristics. Second, the study analyzes the current practical difficulties in regulating such conduct in China. Finally, leveraging international experience, the paper proposes a regulatory path suited to China’s context. The research aims to provide theoretical support for antitrust legislation and enforcement in the digital economy, facilitate the development of a well-regulated legal environment for digital markets, and contribute to the goal of building a socialist rule-of-law state.
