Abstract: Although the Patent Law clearly stipulates patent inventiveness, in practical operation, there are still many disputes over the judgment of patent inventiveness due to the complexity and diversity of technologies as well as the subjectivity of the judging bodies. By studying the selfie stick patent invalidation case, this paper explores the impact of technical fields on the judgment of patent inventiveness, aiming to provide references for improving the standards and methods of patent inventiveness judgment.
