On the Principle of Appropriate Connection in the Jurisdiction of Foreign-Related Civil Litigation

摘要: 2023年修订的《中华人民共和国民事诉讼法》(以下简称《民事诉讼法》)第276条第2款确立了“适当联系原则”，标志着该原则从司法实践上升为法律规定，为涉外民商事案件的管辖权确定提供了指引。然而，“适当联系原则”作为较新的管辖原则，其理论体系仍待完善，实践适用存在不足，未来需通过立法优化与司法实践改进，以适应涉外民商事案件的复杂性与多样性，在保障当事人权益的同时，契合国际民商事司法管辖的通行秩序。

Abstract: Article 276, Paragraph 2 of the “Civil Procedure Law of the People’s Republic of China” (hereinafter referred to as the “Civil Procedure Law”) revised in 2023 established the “principle of appropriate connection”, marking the elevation of this principle from judicial practice to legal provision, and providing guidance for the determination of jurisdiction in foreign-related civil and commercial cases. However, as a relatively new jurisdiction principle, the theoretical system of the “principle of appropriate connection” still needs to be improved, and there are deficiencies in its practical application. In the future, it is necessary to optimize legislation and improve judicial practice to adapt to the complexity and diversity of foreign-related civil and commercial cases, while safeguarding the rights and interests of the parties, and in line with the common order of international civil and commercial judicial jurisdiction.
