电商平台对平台内经营者的监管义务研究
Research on the Regulatory Obligations of E-Commerce Platforms towards Operators within the Platform
摘要: 随着数字经济的快速发展,电商平台已成为连接生产与消费的关键枢纽,其作为市场组织者和管理者的角色日益凸显。平台内经营者数量激增、业态复杂,其经营行为直接影响消费者权益、市场秩序与社会公共利益。因此,明确电商平台对平台内经营者的监管义务,具有重要的理论价值与现实紧迫性。本研究系统分析了电商平台监管义务的理论内涵、法律属性及具体内容,指出其在商事准入、日常运营与违规处置等环节的具体要求。研究进一步揭示了平台在履行监管义务过程中面临的技术能力局限、利益冲突与标准模糊等现实困境。最后,提出通过技术赋能、规则优化、协同治理等体系化路径,提升平台监管效能,构建更加安全、可靠、活跃的平台经济生态。
Abstract: With the rapid development of the digital economy, e-commerce platforms have become a key hub connecting production and consumption, and their role as market organizers and managers has become increasingly prominent. The number of operators within the platform has surged, and the business models have become complex. Their business activities directly affect consumer rights, market order, and social public interests. Therefore, clarifying the regulatory obligations of e-commerce platforms towards operators within the platform holds significant theoretical value and practical urgency. This study systematically analyzes the theoretical connotation, legal attributes, and specific content of the regulatory obligations of e-commerce platforms, pointing out specific requirements in areas such as business access, daily operations, and violation handling. The study further reveals the practical difficulties faced by platforms in fulfilling their regulatory obligations, such as technical capacity limitations, conflicts of interest, and ambiguous standards. Finally, it proposes systematic paths such as technology empowerment, rule optimization, and collaborative governance to enhance the regulatory efficiency of platforms and build a safer, more reliable, and more vibrant platform economic ecosystem.
