价格认定的困境和出路

The Dilemma and Outlet of Price Evaluation

摘要: 价格认定广泛存在于涉财产案件中，价格认定结论书是定罪量刑的重要依据。然而，价格认定结论书存在认定人员技术能力弱、认定程序简单、证据审查规范不明等问题。这些问题源于将价格认定定性为行政确认不当、证据属性不明。根据立法法、行政法的一般原则，价格认定不符合行政确认的特点、价格认证部门履行价格认定职责缺乏正当授权、将价格认定定性为行政确认会损害司法公正和效率。立足于刑事诉讼法定证据分类和实践需要，借鉴域外证据法实践，应当将价格认定纳入司法鉴定。

Abstract: Price evaluation widely exists in property cases, price evaluation conclusion is an important basis for conviction and sentencing. However, there are some problems in the conclusion of price appraisal, such as the weak technical ability of the appraiser, the simple appraisal procedure and the unclear standards of evidence examination. These problems result from the improper administrative confirmation of price assessment and the uncertain attribute of evidence. According to the general principles of legislation law and administrative law, price assessment does not conform to the characteristics of administrative confirmation, price certification departments lack proper authorization to perform the duties of price assessment, and characterizing price assessment as administrative confirmation will damage judicial justice and efficiency. Based on the need of legal evidence classification and practice in criminal litigation, price assessment should be incorporated into judicial expertise by referring to the practice of extra-territorial evidence law.
