B2C电子商务在线纠纷解决的困境与出路
The Dilemma and Way Out for Online Dispute Resolution in B2C E-Commerce
摘要: 随着我国电子商务平台的不断壮大,相关纠纷也不断产生,在线争议解决新模式引起了广泛的关注和讨论。本文总结出目前我国B2C电子商务在线纠纷解决机制的发展困境:公正性存疑、法律规则不完善与难以衔接传统非诉讼制度。在考察了美国和欧盟现有处理模式的基础上,结合我国实践,提出了一些解决建议:完善电子商务纠纷解决的法律制度、建立外部的第三方平台以及实现与传统非诉讼制度的有效衔接。
Abstract: With the continuous growth of e-commerce platforms in China, related disputes have also emerged, drawing widespread attention and discussion to new online dispute resolution models. This paper identifies the current development challenges of China’s B2C e-commerce online dispute resolution mechanisms: doubts about fairness, inadequate legal regulations, and difficulties in connecting with traditional non-litigation systems. Based on an examination of existing models in the United States and the European Union, and in light of China’s practical context, several solutions are proposed: improving the legal framework for e-commerce dispute resolution, establishing external third-party platforms, and achieving effective integration with traditional non-litigation systems.
