数字时代离线权的保障
Guaranteeing the Right to Offline in the Digital Age

摘要: 科技的飞速发展导致劳动者工作时间和休息时间的边界模糊,使得离线权受到广泛关注。为了维护劳动者身心健康、协调劳动者工作和家庭的关系和保障新业态劳动者权益等原因,我国亟待落实离线权。目前许多国家通过立法或政策落实离线权,引入集体谈判制度。我国的制度设计可以采取“法律确认 + 社会协同”的方式,明确离线权的主体,明确举证责任分配,引入容忍义务等手段保障离线权的顺利实施。
Abstract: The rapid advancement of technology has blurred the boundaries between working hours and rest periods for workers, drawing widespread attention to the right to disconnect. To safeguard workers’ physical and mental health, balance work-life relationships, and protect the rights of workers in new industries, China urgently needs to implement the right to disconnect. Currently, many countries have adopted the right to disconnect through legislation or policies, introducing collective bargaining systems. China’s institutional design could adopt a “legal recognition + social coordination” approach, clarify the subjects of the right to disconnect, define the allocation of burden of proof, and introduce tolerance obligations to ensure the smooth implementation of the right to disconnect.
