电商背景下网络支付中电子证据的审查与适用研究

Research on the Review and Application of Electronic Evidence in Online Payment under the Background of E-Commerce

摘要: 随着数字经济的深度发展，在电商经济中网络支付已成为社会经济活动的主流交易方式，其衍生的电子证据(如支付记录、交易日志、电子签名等)在民事诉讼中的地位日益凸显。然而，网络支付电子证据具有无形性、易篡改性、技术依赖性等特质，导致司法实践中面临审查标准模糊、原件认定困难、保全程序不规范、证明力判断失衡等问题。本文以现有立法规范与司法实践为基础，结合《民事诉讼法》《人民法院在线诉讼规则》等相关规定，系统分析网络支付电子证据的审查维度与适用困境，提出从细化审查标准、完善保全机制、明确原件认定规则、构建证明力分级体系等方面优化路径，旨在为司法实践中网络支付电子证据的规范适用提供理论支撑与操作指引，推动数字时代司法证明规则的完善。

Abstract: With the in-depth development of the digital economy, in the e-commerce economy online payment has become the mainstream transaction mode of socio-economic activities, and the electronic evidence derived from it (such as payment records, transaction logs, electronic signatures, etc.) is increasingly prominent in civil litigation. However, online payment electronic evidence has the characteristics of intangibility, easy tampering, technical dependence and other characteristics, which leads to problems such as vague examination standards, difficult identification of originals, non-standard preservation procedures, and imbalance in probative judgment in judicial practice. Based on the existing legislative norms and judicial practice, combined with the “Civil Procedure Law”, the “Online Litigation Rules of the People’s Court” and other relevant provisions, this article systematically analyzes the examination dimension and application dilemma of online payment electronic evidence, and proposes to refine the examination standards, improve the preservation mechanism, clarify the rules for the identification of originals, and construct the strength of proof. The optimization path in terms of level system and other aspects aims to provide theoretical support and operational guidelines for the normative application of online payment electronic evidence in judicial practice, and promote the improvement of judicial certification rules in the digital age.
