电子商务平台汽车交易侵权问题研究
Research on Infringement Issues in Automobile Transactions on E-Commerce Platforms
摘要: 随着数字经济的深入发展,电商平台已从标准化小商品交易渗透至汽车等高价值、长链条的非标品交易领域,形成了涵盖新车、二手车、零部件及售后服务的庞大生态。然而,交易场景的虚拟化、参与主体的多元化以及汽车商品的特殊性,使得该领域的消费者侵权问题呈现出复杂化、系统化和隐蔽化的特征。本文系统梳理了电商平台汽车交易中信息不实、产品质量、合同履约及售后服务四大核心侵权类型,并深度剖析其背后信息不对称极端化、平台治理失灵、法律法规滞后与消费者维权困局等多重成因。论文重点围绕《电子商务法》第三十八条,深入探讨了电商平台“明知或应知”状态下连带责任的认定边界,并引入“技术赋能治理”理念,最终构建了一个以“平台内控为基础、法律法规为保障、技术信任为核心、多元共治为驱动”的综合治理体系,旨在为保障消费者权益、规范平台经营行为、促进汽车电商产业可持续发展提供理论参考与实践路径。
Abstract: With the in-depth development of the digital economy, e-commerce platforms have expanded from the transaction of standardized small commodities to the field of high-value, long-chain non-standard commodity transactions such as automobiles, forming a vast ecosystem covering new cars, used cars, auto parts, and after-sales services. However, the virtualization of transaction scenarios, the diversification of participating entities, and the particularity of automobile commodities have led to consumer infringement issues in this field characterized by complexity, systematization, and concealment. This paper systematically sorts out four core types of infringement in automobile transactions on e-commerce platforms, namely false information, product quality, contract performance, and after-sales services, and conducts an in-depth analysis of the multiple underlying causes, including the extreme information asymmetry, platform governance failure, lagging laws and regulations, and the dilemma of consumer rights protection. Focusing on Article 38 of the E-Commerce Law, the paper explores in depth the identification boundary of joint liability for e-commerce platforms when they are in a state of “knowing or ought to know” (about infringements). Furthermore, it introduces the concept of “technology-empowered governance” and finally constructs a comprehensive governance system featuring “platform internal control as the foundation, laws and regulations as the guarantee, technological trust as the core, and multi-stakeholder co-governance as the driver”. The purpose of this study is to provide theoretical references and practical paths for safeguarding consumer rights, standardizing platform operation behaviors, and promoting the sustainable development of the automobile e-commerce industry.
