论我国醉酒犯罪的刑事责任

On the Criminal Responsibility of Drunken Offences in China

摘要: 当下醉酒犯罪频发，对于醉酒犯罪所应当承担的刑事责任问题也越来越受到争议，在第十三届全国人大五次会议中也对醉驾的刑事责任问题提出了讨论。中国刑法第18条第四款规定“醉酒的人犯罪，应当负刑事责任”，虽然从法律的角度对于醉酒犯罪是否应当负刑事责任做出了肯定回答，但是对于醉酒人犯罪的责任界定仍饱受争议，由此可见，研究醉酒犯罪的法律适用问题很有必要，本文将根据醉酒犯罪刑事责任的理论分歧、理论依据、我国刑法在立法上的不足等对各方面对醉酒犯罪刑事责任问题进行完善。

Abstract: Currently, drunken offences are occurring frequently, and the issue of criminal responsibility for such offenses has sparked increasing debate. During the Fifth Session of the 13th National People’s Congress, discussions were raised regarding the criminal liability for drunk driving. Article 18, Paragraph 4 of the Criminal Law of China stipulates that “a person who commits a crime while intoxicated shall bear criminal responsibility”. Although this provision affirms the criminal liability of intoxicated individuals from a legal standpoint, the definition of their responsibility remains contentious. This underscores the necessity of studying the legal application of drunken offences. This article will address the theoretical disputes, legal foundations, and legislative gaps in China’s Criminal Law concerning the criminal liability of intoxicated offenders, aiming to improve the framework for determining such liability.
