算法推荐下电商短视频平台版权治理的制度重构

The Institutional Reconstruction of Copyright Governance of E-Commerce Short Video Platforms under Algorithm Recommendation

摘要: 本文聚焦算法推荐时代电商短视频平台的版权治理困境，指出传统治理框架在平台角色转型、技术赋能与制度规制协同等方面存在失效逻辑。通过解构现有法律规制、平台治理及技术治理层面的内在机理，揭示规模化侵权、商业利益冲突及立法滞后等核心问题。提出在法律层面为电商短视频平台设定过滤义务，从法律规制升级、行政监管强化及事后权利救济三个维度设计制度重构路径，旨在实现平台责任与创作自由的动态平衡。

Abstract: This paper focuses on the copyright governance dilemma of e-commerce short video platforms in the era of algorithm recommendation, and points out that the traditional governance framework has failed logic in terms of platform role transformation, technology empowerment and institutional regulation coordination. By deconstructing the internal mechanisms of existing legal regulation, platform governance, and technical governance, this paper reveals core issues such as large-scale infringement, commercial conflicts of interest, and legislative lag. It is proposed to set filtering obligations for e-commerce short video platforms at the legal level, and design a system reconstruction path from three dimensions: upgrading legal regulation, strengthening administrative supervision and post-event rights relief, aiming to achieve a dynamic balance between platform responsibility and creative freedom.
