Analysis of Delivery Conditions of Commercial Housing

摘要: 本文以2022年“保交楼”政策为背景，聚焦商品房交付条件的法律规范冲突与司法裁判分歧问题。通过对比《中华人民共和国民法典》《建设工程质量管理条例》等中央立法与地方性法规的差异，揭示“五方验收说”与“验收备案说”的规范冲突根源，并结合最高人民法院及地方高院的典型案例，系统归纳裁判分歧的本质。研究发现，立法层级冲突与行政监管介入民事交付的界限模糊是矛盾核心。本文建议通过司法解释明确“验收备案”的行政管理属性，制定统一立法标准，并发布指导性案例以统一司法尺度，最终实现行政监管、市场自律与司法裁判的协同治理。

Abstract: This article examines the legal conflicts and judicial discrepancies in property delivery conditions under China’s 2022 “Property Delivery Guarantee” policy. By comparing the differences between central legislation such as the “Civil Code of the People’s Republic of China” and “Regulations on Quality Management of Construction Projects” and local regulations, it identifies the root causes of disputes between the “Five-Party Acceptance Theory” and the “Acceptance Filing Theory”. Through analyzing landmark cases from the Supreme People’s Court and local high courts, the study systematically reveals the essence of judicial disagreements. The research highlights that the core contradiction lies in the blurred boundaries between legislative hierarchy conflicts and administrative intervention in civil delivery. The paper proposes clarifying the administrative nature of “acceptance filing” through judicial interpretations, establishing unified legislative standards, and issuing guiding precedents to harmonize judicial practices. Ultimately, this approach aims to achieve coordinated governance among administrative supervision, market self-regulation, and judicial adjudication.
