事业单位规章制度与聘用合同协同机制研究
Research on the Coordination Mechanism between Rules and Regulations and Employment Contracts of Public Institutions
摘要: 随着事业单位人事制度改革的深化,规章制度与聘用合同共同构成了人事管理的核心。然而,两者在实践中时有冲突,影响了人事关系的和谐稳定。本文旨在厘清二者的法律定位与相互关系,明确规章制度作为管理基础的普遍性与聘用合同作为个体约定的特殊性,并借鉴“特别法优于一般法”的法理精神,探讨其规范层级。在此基础上,文章提出了处理二者冲突的三大核心原则:订立时已有制度的默认适用原则、合同特别约定优先原则、以及新制度适用中的协商原则。最终,文章强调通过规范制度制定、精细化合同订立及建立动态协调与沟通机制,构建规章制度与聘用合同的协同机制,是保障事业单位人事关系和谐稳定的关键路径。
Abstract: With the deepening of personnel system reform in public institutions, regulations and employment contracts together constitute the core of personnel management. However, conflicts often arise between the two in practice, affecting the harmony and stability of personnel relations. This article aims to clarify their legal positioning and interrelationship, defining the universality of regulations as the foundation of management and the particularity of employment contracts as individual agreements. Drawing on the legal principle of “special law prevails over general law”, it explores their normative hierarchy. Based on this, the article proposes three core principles for handling conflicts between the two: the principle of default application of existing regulations at the time of contract signing, the principle of priority for special contractual agreements, and the principle of negotiation in the application of new regulations. Finally, the article emphasizes that constructing a collaborative mechanism between regulations and employment contracts through standardized system formulation, refined contract signing, and the establishment of dynamic coordination and communication mechanisms is a key path to ensuring the harmony and stability of personnel relations in public institutions.
