摘要: 近年来，网络爬虫技术的广泛应用引发了对其刑事违法性边界的讨论。本文从刑法学视角出发，结合技术原理与法律规范，论证网络爬虫行为可能构成的刑事违法性。首先，通过分析爬虫技术的基本逻辑与典型应用场景，明确其技术中立性及潜在滥用风险。其次，聚焦非法获取计算机系统数据罪、破坏计算机信息系统罪及侵犯公民个人信息罪等罪名，厘清违法性判断标准：包括突破技术防护措施、违反Robots协议、数据属性敏感性和规模性等因素。同时结合案例探讨司法实践中对爬虫行为违法性的具体认定规则。

Abstract: In recent years, the widespread application of web crawler technology has triggered discussions on the boundary of its criminal illegality. From the perspective of criminal law, this paper demonstrates the potential criminal illegality of web crawler behavior by combining technical principles and legal norms. Firstly, by analyzing the basic logic and typical application scenarios of crawler technology, it clarifies its technical neutrality and potential abuse risks; secondly, it focuses on core charges such as the crime of illegally obtaining computer system data, the crime of damaging computer information systems, and the crime of infringing on citizens’ personal information, and clarifies the key elements for judging illegality, including breaking through technical protection measures, violating the Robots protocol, and the sensitivity and scale of data attributes; finally, combined with judicial practice cases, it explores the specific rules for determining the illegality of crawling behavior.
