摘要: 人工智能技术飞速发展，其模型训练涉及对大量作品的获取和利用，训练出的生成物具有丰富性和多样性，对文化、科学领域有积极意义。对于该过程是否均在著作权权利范围内，需要对其进行拆解和分类讨论。此外，市场难以对资源进行有效配置，因此需要建立人工智能模型训练能够适用的合理使用条款并对其进行限制，以平衡著作权人和技术发展之间的利益。

Abstract: The rapid advancement of artificial intelligence (AI) technologies has necessitated the acquisition and utilization of extensive copyrighted works for model training. The resulting generated outputs exhibit remarkable diversity and richness, demonstrating significant implications for cultural and scientific domains. However, whether such processes entirely fall within the scope of copyright permissions requires a deconstruction and categorical analysis of their legal boundaries. Furthermore, due to the inherent market failure in efficiently allocating resources, it is imperative to establish fair use provisions tailored to AI model training, accompanied by appropriate limitations, to strike a balance between the interests of copyright holders and the imperatives of technological innovation.
