社区养老公共数据授权运营的基层实践困境与法治出路——以街道办事处为中心

The Dilemma and Legal Solution of the Grassroots Practice of Authorizing the Operation of Public Data for Community Elderly Care—Centered on the Sub-District Office

摘要: 我国老龄化程度持续加深，社区养老公共数据的授权运营已成为提升养老服务效能的关键。然而，作为数据流转关键节点的街道办事处，在实践中面临“街道悖论”——承担核心授权职能却缺乏合法资质，导致授权运营陷入主体、程序与监管的三重困境。文章通过剖析街道办事处法律地位的局限性与授权行为的性质，揭示其合法性危机的制度根源，进而提出构建“法律赋能”与“程序控权”相结合的法治化框架，为破解基层数据治理困境提供系统性出路。

Abstract: The degree of aging in our country continues to deepen, and the authorized operation of public data for community elderly care has become the key to improving the efficiency of elderly care services. However, as a key node in data circulation, the sub-district office is confronted with the “sub-district paradox” in practice—undertaking core authorized functions but lacking legal qualifications, which leads to the authorization operation falling into a triple predicament of subject, procedure and supervision. This article analyzes the limitations of the legal status of sub-district offices and the nature of their authorization behaviors, reveals the institutional root cause of their legitimacy crisis, and then proposes to build a legal framework that combines “legal empowerment” and “procedural control of power”, providing a systematic solution to the predicament of grassroots data governance.
