“七天无理由退货”制度的例外情形适用困境与完善对策
Exceptions to “Seven-Day No-Reason Return”: Dilemmas and Countermeasures
摘要: 电商平台中的“七天无理由退货”制度在网络消费中发挥重要作用。然而法律、科技以及商业实践的快速发展,使得其例外情形适用面临困境。要解决这些问题,不能单靠单一主体的努力,而是需要立法者、监管者、平台、经营者与消费者协同合作,形成治理合力。通过细化规则标准、强化平台责任、创新利益平衡机制等多种方式,我们能够在保护消费者“后悔权”的同时,维护经营者的合法权益,找出最佳的平衡点。这样才能确保我国的电子商务市场在法治的轨道上行稳致远。
Abstract: The “seven-day no-reason return” system on e-commerce platforms plays a vital role in online consumption. However, the rapid development of law, technology, and business practices has led to challenges in applying its exceptions. Resolving these issues cannot rely solely on the efforts of a single entity; instead, it requires collaborative governance, forming synergy among legislators, regulators, platforms, operators, and consumers. By refining rule standards, strengthening platform accountability, and innovating interest balance mechanisms, among other methods, we can protect the consumer’s “right to regret” while safeguarding the legitimate rights and interests of operators, ultimately finding the optimal balance. This approach will ensure that China’s e-commerce market continues to develop steadily within the framework of the rule of law.
