电子商务C2C模式中的消费者维权法律问题研究
Research on Legal Issues of Consumer Rights Protection in the E-Commerce C2C Model
摘要: 随着数字经济的快速发展,电子商务C2C模式凭借其灵活性与普惠性成为激活闲置资源、促进个体交易的重要载体。本文以电子商务C2C模式的核心特征以及C2C模式消费者维权的特殊性为切入点,聚焦消费者维权面临的经营主体身份确认困难、维权举证困难且成本高、平台法律责任边界模糊三大核心法律困境。从经营主体、消费者及平台三方面系统剖析其成因后,提出针对性解决对策:其一,规范主体登记与信息公示,夯实身份确认基础;其二,优化证据规则与维权机制,破解举证与成本困境;其三;明确平台责任清单与监管机制,夯实平台主体责任。研究旨在完善C2C模式消费者维权法律体系,切实保障消费者合法权益,促进电子商务C2C模式的健康可持续发展,为数字经济法治建设提供有益参考。
Abstract: With the rapid development of the digital economy, the e-commerce C2C model has become an important carrier for activating idle resources and promoting individual transactions due to its flexibility and inclusiveness. Starting from the core characteristics of the e-commerce C2C model and the particularities of consumer rights protection in this model, this paper focuses on three core legal predicaments faced by consumers in rights protection: difficulty in identifying the legal identity of business entities, difficulty in burden of proof and high cost in rights protection, and ambiguity in the boundary of platform legal liability. After systematically analyzing the causes from three aspects—business entities, consumers, and platforms—this paper proposes targeted solutions: firstly, standardize subject registration and information disclosure to lay a solid foundation for identity confirmation; secondly, optimize evidence rules and rights protection mechanisms to address the predicament of burden of proof and high costs; thirdly, clarify the platform’s liability list and supervision mechanism to consolidate the platform’s primary responsibility. The research aims to improve the legal system for consumer rights protection in the C2C model, effectively safeguard consumers’ legitimate rights and interests, promote the healthy and sustainable development of the e-commerce C2C model, and provide useful references for the legal construction of the digital economy.
